This renewal of a Nonsite-Specific Land Application Permit, allows the Carmel Wastewater Treatment Plant to land apply municipal biosolids to agricultural land in Bartholomew, Boone, Clinton, Hamilton, Howard, and Tipton Counties. The final decision is available online via IDEM's Virtual File Cabinet (VFC). Please go to: http://vfc.idem.in.gov/. You will then have the option to search for approval documents using a variety of criteria. APPEAL PROCEDURES If you wish to challenge this decision, IC 13-15-6-1 and IC 4-21.5-3-7 require that you file a Petition for Administrative Review. NOTICE OF DETERMINATION TO CONSTRUCT AND FINANCE IMPROVEMENTS TO THE SEWAGE WORKS OF THE TOWN OF MONTGOMERY, INDIANA AND THE ADOPTION AND PURPORT OF THE ORDINANCE AUTHORIZING THE SAME On October 15, 2018, the Town Council of Montgomery, Indiana (the Town) adopted a Bond Ordinance (the Bond Ordinance) thereby determining and ordering the construction of certain improvements and renovations to the existing sewage works system of the Town, including but not limited to (a) televising 10,500 linear feet of 8-inch mainline sewers and 96 laterals along these sewers, (b) lining the sewers and laterals from the sewer to the property line with a new cured-in-place pipe; ( c) and any related improvements thereto (the Project). The Bond Ordinance orders and directs that the cost of the improvement project will not exceed $1,100,000, plus investment earnings on such amount, which will be funded by the Town from the proceeds of sewage works revenue bonds issued in an aggregate principal amount not to exceed $400,000 (the Bonds), an OCRA Grant in the amount of $700,000 as well as legally available funds, if necessary. The Bonds will be payable solely from the net revenues of the sewage works (as defined in the Bond Ordinance) on parity with the Prior Bonds (as defined in the Bond Ordinance). A copy of plans and specifications for the Project and the Bond Ordinance are available for examination and copying at the office of the Clerk-Treasurer located at 370 N. Main Street, Montgomery, Indiana, during normal business hours. Objections to this project and the Bonds may be filed in the time and manner provided by IC 36-9-23. The Bonds are being issued for the purpose of procuring funds for the renovation of and improvements to Walton & Tipton Township Public Library, including the purchase of technology and equipment, and will be the direct obligations of the Library, payable out of ad valorem taxes to be collected on the taxable property within the Library; however, the Library's collection of the levy may be limited by operation of I.C. 6-1.1-20.6, which provides taxpayers with tax credits for property taxes attributable to different classes of property in an amount that exceeds certain percentages of the gross assessed value of that property. The Library is required by law to fully fund the payment of debt service on the Bonds in an amount sufficient to pay the debt service, regardless of any reduction in property tax collections due to the application of such tax credits. The Library may not be able to levy or collect additional property taxes to make up this short fall. The Library is a library organized pursuant to the provisions of I.C. 20-23, and the bonds will not be private activity bonds as defined in Section 141 of the Code.
