K. The contractor awarded work shall be required to furnish an acceptable surety bond in the full amount of the contract. L. Pursuant to IC 5-16-13-7, the provisions of the law are incorporated by reference in each public works contract and Contractor agrees that pursuant to IC 5-16-13-8 the public works project will not be structured other than in the contractor tier structure required by law. Public Notice Des. No. 1400713 and 1401747 The City of Goshen, Indiana is planning to undertake a roadway improvement project funded in part by the Federal Highway Administration (FHWA). The project is located along Kercher Road, between the Norfolk Southern Marion Line and US 33. Under the preferred alternative, the proposed project would involve widening the existing roadway typical section to provide one 12-foot travel lane in each direction, a 14-foot two-way left turn lane (TWLTL) and combined concrete curb and gutters, curb inlets, and storm sewer throughout the project corridor. A new, 10-foot wide sidewalk is proposed on the south side of the roadway, with a 5-foot sodded buffer strip between the back of the curb and sidewalk, where space permits. The project also includes water main relocations within the limits of existing and proposed right of way and relocation of an existing drainage basin on the south side of the roadway. The project will require acquisition of land for right of way purposes; however, no business or residential relocations are required. A Section 106 review was initiated in March 2015 for a previous iteration of this project. That project included two phases: Phase I (Des. No. 1400713), beginning at the Kercher Road crossing of the Norfolk Southern Marion Line and ending at Dierdorff Road; and, Phase II (Des. No. 1401747), beginning at Dierdorff Road and ending at US 33. The Section 106 review culminated with a No Adverse Effect finding dated February 26, 2016. The Section 106 review was reinitiated due to project modifications proposed in Phase II of the project. Two properties eligible for listing in the National Register of Historic Places were originally identified within the Area of Potential Effects (APE) established for the project. The first property, Violett-Martin House and Gardens (NR-1600; IHSSI No. 039-243-53241) is within Phase I of the project. The 2016 finding pertaining to this property was No Historic Properties Affected. The second property, Yoder-Koerner Farmstead (IHSSI No. 039-243-53235) was within Phase II of the project. The 2016 finding pertaining to this property was No Adverse Effect; however, this property is no longer extant. Therefore, the proposed action does not impact properties listed in or eligible for the National Register of Historic Places. The Indiana Department of Transportation (INDOT), on behalf of the FHWA, has issued a No Historic Properties Affected finding for the project due to the fact that the NRHP listed/eligible properties within the APE will not be impacted by the undertaking. In accordance with the National Historic Preservation Act, the views of the public are being sought regarding the effect of the proposed project on the historic elements as per 36 CFR 800.2(d), 800.3(e) and 800.6(a)(4). Pursuant to 36 CFR 800.4(d)(1), the documentation specified in 36 CFR 800. 11(d) is available for inspection in DLZ Indiana, LLCs South Bend Office located at 2211 E. The funds to meet such additional appropriation are to be provided by the sale of real estate to the Concord Community Schools Building Corporation. The foregoing appropriation is in addition to all appropriations provided for in the existing budget and tax levy, and a need for such appropriation exists by reason of the inadequacy of the present buildings to provide necessary school facilities.
